The draft Animal Rights and Protection law prohibits sales in stores, establishes courses to facilitate responsible ownership and will allow the removal of a pet from its owner if the owner does not guarantee its rights and healthy development.

With a sanctioning regime that can reach up to 600,000 euros for very serious infractions, it also provides for accessory measures for non-compliance that can lead to the confiscation of the animal and its delivery to a protection entity.

The text includes other new developments in animal protection, such as the requirement that pet owners “pass a training course” that facilitates “responsible ownership of the animal” and take out civil liability insurance.

Through this training, it is intended that the owner develop basic knowledge “in the management, care and possession of animals.”

Other points introduced by the new legislation are the prohibition of sacrificing pets, except for “sanitary or euthanasia reasons”, or the prohibition of using them as advertising claims if there is no prior authorization.

Furthermore, its integration into nativity scene exhibitions, parades or processions “where the animal is kept in an unnatural manner” is prohibited.

To facilitate this interpretation, the draft proposes the creation of a positive list of species that can be considered companion animals and that respond to four criteria: animal welfare, management and breeding, environment and human health and safety.

On the other hand, it establishes three days as the maximum time that any pet can be left unsupervised, although it mentions that, in the case of dogs, this period may not exceed twenty-four consecutive hours.

Likewise, the draft regulates access to public and private transport for those pets that “do not constitute a risk to people” and establishes that taxi and VTC drivers who accept them in their vehicles have “the right to receive a supplement” previously established by the competent authority.

In this sense, it stands out that public and private establishments “such as hotel accommodations, beaches, restaurants or bars” that do not allow the entry and stay of animals must show it by means of a sign “visible from the outside” let him point it out.

With respect to its commercialization, and if the future law is approved with its current wording, the sale of species in pet stores will be prohibited, as well as their display and exhibition to the public for commercial purposes, excluding fish.

Furthermore, the person responsible for an animal will be responsible for any possible damage that it could cause to other people, animals or things, to roads or public spaces and to the natural environment.

In the sanctions section, There are three different types: mild, serious and very serious.

In the case of minor infractions, fines will range between 600 and 30,000 euros; in serious cases, between 30,001 and 100,000 euros, and in very serious cases, 100,001 and 600,000 euros.

In addition, the possibility of disqualifying the owner from owning animals “for a maximum period of five years for serious infractions and five to ten years for very serious infractions” is provided as accessory sanctions.
