After fulfilling his dream of being a father, a trans man takes paternity leave

The arrival of the first daughter of Glaucon Vital49, and his wife Marcela Santoro, 34, was a milestone not just in their lives, but for the entire trans community. After the baby was born, he was the first transgender man to be granted paternity leave by city hall.

Glauco is an employee of Special Coordination for Sexual Diversity (CEDS Rio)and told how it was to be the first trans person to get this right, which is guaranteed by the CLT law.

“It was wonderful! Not only because I was able to contribute by helping my wife take care of the baby, but also because it was a unique moment in a father’s life, the moment when you realize how that fragile being needs your dedication all the time, and that you will love you unconditionally for the rest of your life,” he said in an interview with CLAUDIAcheered up.

After losing the first pregnancy they tried through artificial insemination, Glauco revealed that he fulfilled a dream with the arrival of little Giovanna, who turned one month old on Thursday (12). “I particularly always wanted to be a father. It is a dream of many years coming true thanks to the support of my wife, friends and family”, he said excitedly.

The process to apply for the license was simple, and Glauco had the full support of the entire team where he works. “I turned to the HR department of the city hall, through CEDS Rio where I work. I took the documents they asked for, and the license was immediately granted. By law, the father has the right to stay from five to 20 days, and the city hall granted me the 20”.

According to lawyer Maria Eduarda Aguiar da Silva, 46, the fact that Glauco is a trans man does not deprive him of the right to enjoy the laws that involve the work environment and any other. “Glauco ends up achieving a great achievement because he had his gender identity respected, and he achieved a right that belongs to all men, whether they are cis or trans”, she said.

As the first person to obtain this right, Maria Eduarda hopes that Glauco’s case will influence other trans people to seek their rights and ensure that they can enjoy these and other benefits. “It is important because it sets a precedent for trans men who will need to get this license. It is a right with respect to the gender identity of each one of them”, said the lawyer.

“We are making a lot of progress with these issues of understanding, and the rights given to cis men need to be given to trans men. We have to work on isonomy, which is a conditional right of equal rights under the same conditions”.

In addition, the lawyer states that if this right is denied by the company, it is necessary to appeal in court. “The first step is to talk to HR, inform them that the child was born and apply for paternity leave. If this is denied, it is necessary to resort to justice. We need to be seeking to take legal action on these bodies to achieve this right, ”she added.

Glauco’s recurrence opens doors for other people to also enjoy their rights at work. “For the trans population, and in this case in particular for us trans men, it is very important. It is one of the ways to show that we are citizens like any other. And that as citizens, we have to have our rights also respected. In other words, we just want respect. And this is everyone’s right”, concluded Glauco.
