Then it is necessary to go to a Police Station, if possible one specialized in Cyber Crimes, to register the occurrence.

Finally, the internet provider must request the removal of offensive content, which, according to Marco Civil, does not require a court order in cases of disclosure of material containing scenes of nudity or sexual acts of a private nature.

Dr. Dalila also states that the legal measures range from the request for the removal of the content to the possibility of filing a civil and criminal action, depending on the responsibility of each process.

In civil action, the victim can obtain financial compensation, in criminal action, depending on the crime, the defendant may be arrested. It is up to the victim and the lawyer to decide together which paths they will follow.

Carolina Dieckmann Law

In 2012, then-President Dilma Rousseff sanctioned the Brazilian Law 12,737/2012, which became known as the Carolina Dieckmann Law. The law typifies cyber crimes or offenses, such as breaking into telephone devices to obtain private data.

The Carolina Dieckmann Law got its nickname because it was born after the illegal and unauthorized disclosure of intimate photos of the actress. At the time, the hacker threatened to release Carolina’s photos if she did not pay the amount requested by him.
