Adoption FAQs

Here are the most frequently asked questions from those who are interested in adopting or are at least considering the possibility of adopting and don’t know where to start:

Who can apply? Any person of legal age, in any condition of marital status, as long as they are 16 years older than the adopted person. Who can be adopted? Any child or adolescent up to 18 years of age, who lives in care units, and whose parents have died or who have given up custody. There is also the possibility of adopting adults, in accordance with the rules of the Brazilian Civil Code. How to become fit? Attend preparatory classes for adopters, receiving guidance on procedures, laws and rules, in addition to undergoing assessments to be classified as suitable or not. Is there a “step by step” for adoption? It is necessary to have the responsibility and the certainty that you want to adopt. Afterwards, just go to a Childhood and Youth Court or the Public Prosecutor’s Office in the Forum. There applicants receive all the necessary guidance to become qualified. After qualification, the person is enrolled in the National Adoption Registry (CNA) and will be summoned as soon as a child appears within the requested profile. How much does it cost to adopt? There is no cost, the person does not pay court costs and does not need a lawyer.

8. What should be the age difference between adopter and adoptee? The law says that there must be a difference of at least 16 years of age between the adopter and the adoptee. Although adoption between adults is possible; By analogy with the provisions of the Child and Adolescent Statute, this difference remains, and the adopter must be at least 16 years older than the adoptee.

9. What is the minimum income to apply? Adoption can occur regardless of the income of people interested in adopting a child and/or adolescent. If necessary, the applicant may even receive financial assistance.

10. How long does the application process take until adoption? As in the system there are more people wanting to adopt than “available” children, this only depends on the “profile” indicated by the adopter. Everything happens more quickly if the person does not indicate restrictions on age, sex, color, whether the child has illnesses/disabilities or not, and if he is willing to adopt siblings.

11. What does “coexistence stage” mean? This is the period in which the candidate and child have closer contact and the participants’ bond and affinity are evaluated. It is a very important phase of the adoption process. This stage has a maximum period of 3 months.
